Licensing
1. Please be advised that pursuant to section 90 of the Communications Act, every person that is currently operating or wishes to establish and operate radiocommunication services; or install radio transmitting equipment (i.e VSAT Terminals) in Tonga must apply for an approved licence from the Regulator, unless this has been exempted in accordance with the Radio Spectrum Rules.
Eligibility
2. Subject to sub-paragraph (1), every person applying for a licence must meet the following criteria to become eligible for an application of licence:
- a company as defined under the Companies Act 1995;
- a natural person who is a citizen of the Kingdom and of at least 18 years of age;
- a partnership, one of the members of which is a citizen of the Kingdom and of at least 18 years of age;
- a charitable trust, incorporated society, or other body organized under a law of the Kingdom that has capacity to contract;
- a government school, recognized school or registered school under the Education Act 2013; or
- an entity listed in Schedule 1 of the Public Service Act 2002.
Process of Applying for a Licence
3 All applications must be filled in a form provided by the Regulator and submitted for assessment. Upon receipt of the application with supporting documents, the applicant will be informed by the Regulator’s decision to either grant or refuse the application within twenty (20) working days unless there are further information required with an extended time.
